Limited Warranty for New Diamond Tyres & Tubes

This Limited Warranty applies to any new Diamond motorcycle/bicycle/ rickshaw/wheel-barrow tyre, bearing Diamonds name and complete details, and inner-tubes (collectively, Tyres) bearing Diamonds name. Tyres furnished or sold by Diamond that have been used on motorcycle/bicycle/ rickshaw/wheel-barrow in accordance with the motorcycle/bicycle/ rickshaw/wheel-barrow manufacturers and Diamonds Care & Maintenance Standards, instructions are eligible for this Limited Warranty. If a Tyre becomes unserviceable due to a covered warranty condition, it will be repaired or replaced with a comparable Tyre free of cost (Terms & Conditions Apply). A replaced Tyre may be the same line of tyre or another line. If a comparable Tyre is not available, Diamond will provide a credit or other allowance deemed suitable by Diamond. Whether a Tyre has a covered warranty condition will be determined by inspection of the returned product. Any condition present as a result of a Tyre having been exposed or subjected to: (i) Alteration, modification, maintenance, repair, installation, handling, transportation, storage, operation or use after delivery that, in Diamonds judgment, is improper or otherwise not in compliance with Diamonds Care and Maintenance Standards; or (ii) Accident, contamination, foreign object damage, abuse, neglect or negligence occurring after delivery; or (iii) Damage caused by any motorcycle/bicycle/ rickshaw/wheel-barrow part not supplied by Diamond is not a covered warranty condition and Diamond assumes no responsibility for such condition. THIS LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES OF DIAMOND WITH RESPECT TO DIAMOND MOTORCYCLE/BICYCLE/RICKSHAW/WHEEL-BARROW TYRES AND TUBES, WHETHER WRITTEN OR ORAL, EXPRESS, IMPLIED,OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE, WHICH ARE HEREBY EXPRESSLY DISCLAIMED. IN NO EVENT SHALL DIAMOND BE LIABLE UNDER THIS WARRANTY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. DIAMONDS LIABILITY SHALL NOT EXCEED THE NET PURCHASE PRICE OF THE TYRE, AFTER ALL DISCOUNTS. NO EXTENSION OF THIS WARRANTY SHALL BE BINDING UPON DIAMOND UNLESS SET FORTH IN WRITING AND SIGNED BY A DIAMOND AUTHORIZED REPRESENTATIVE. To the extent any tyre condition is covered by any other warranty, such as a warranty from a third party repairer, Diamond will have no responsibility for that condition. To submit a claim under this Limited Warranty, the tyre must be returned to the point of purchase, freight prepaid, by the owner or end-user for inspection. A Diamond claim form, completely filled out and signed by the owner or end user, is required. Do not return any item without prior approval.
